House Targets Human Trade
The House of Representatives on Tuesday ratified a United Nations protocol against human trafficking, taking a long-awaited step toward recognizing and dealing with the country’s growing trafficking problem.
Ten House factions agreed during a plenary session to ratify the protocol, which aims to stop and punish human traffickers, particularly those trafficking women and children, and is part of the UN Convention Against Transnational Organized Crime.
The House finally ratified the convention last December, nine years after the government signed it in Palermo, Italy, giving Indonesia a stronger legal basis from which to fight organized crime.
Justice and Human Rights Minister Andi Mattalatta, who represented the central government at Tuesday’s plenary session, said the country’s current laws on human trafficking were only applicable “at the national level.”
“Ratification of this protocol will protect women and children from the crime of trafficking and will improve Indonesia’s image in the global community,” Andi said, adding that the government will follow the ratification with a campaign against trafficking.
“The campaign is needed to raise awareness within our legal structure that we have to change our approach to tackling crime — this means transnational crime, including human trafficking.”
Local and international groups have estimated that more than 100,000 Indonesian women and children are trafficked annually for commercial sexual exploitation, including to Malaysia, Singapore and Hong Kong.
Indonesia was placed in Tier 2 in the 2007 US Department of State’s Trafficking in Persons Report for failing to fully comply with the Trafficking Victims Protection Act’s minimum standards for the elimination of trafficking, despite efforts to do so. There have been reports of police officers, soldiers and government officials who been involved in trafficking.
Legislator Bambang Sadono of the Golkar Party said human trafficking remained a serious problem, despite several laws addressing the issue.
“The problem is related to the weakness of Indonesian law enforcement,” he said.
There are many signs that the country is both a source and transit point for human trafficking activities. Bambang urged the government to focus on border towns, noting that Entikong, West Kalimantan Province, is a notorious hub for trafficking people into the Malaysian state of Sarawak.
“We ask the government to crack down on crimes in West and East Kalimantan,” he said.
Nurdin, a lawmaker from the Indonesian Democratic Party of Struggle, or PDI-P, said women and children were the main targets of traffickers because of their economic value. “We hope Indonesia will no longer be a site for trafficking,” he said.
Anis Hidayah, executive director of nongovernmental organization Migrant Care, said the protocol will be ineffective without the political will to handle trafficking cases. “The legal system in border regions is limited,” she said.
